They don't do flexible. I've got a permanent ineligibility to travel to the us. they might give me a years visa, then you have to reapply when there is 6 months left on it and then they might give you a 2 year visa. If you let it run out you've got to go through the whole embassy bollocks again.

The yanks are especially concerned with crimes of moral tirpitude - my former law partner tells his clients anything to do with sex, drugs and rock n roll and they get jumpy at the border.

Can you not call and cajole them? I realise it'll be really tough, but if they get the inflexible nature of the trip (it's not a weekend away you're booking), perhaps you could urge them to decide in time?

Only glimmer of hope I reckon I have is that it was just over 20yrs ago. I tried getting in 10yrs ago got detained overnight and sent back.

Cheers everybody for all the advice. Didn't get a visa but the fella has appealed it for me and recommended that I should have one but it has to go through homeland security and some other agency, so got to wait 6-8 months for an answer.

They are a lot more relaxed than they used to be. I know of a chap who committed a massive fraud (collected funds for charity claiming to be running a marathon, never had any intention). Not only did they welcome him in, but apparently he is now in training for a title fight having become something of a Golden Boy on the Nevada fight scene.
